Divorce/Legal Separation

In Wisconsin, a divorce or legal separation involves a very similar legal process. In a divorce or legal separation, financial matters are resolved, including the disposition of all of the assets and property, allocation of any debts, and the payment of support, including child support, maintenance (known in other states as alimony or spousal support), and/or family support. Also, in a divorce or legal separation, issues regarding the children are resolved, including physical placement, which is the schedule the children have with both parents, and also legal custody, which is the right to make major decisions regarding the children.



Child Custody/Placement

In a child custody and placement determination, issues regarding the children’s schedule with both parents, and also decision making rights regarding the children, are determined. Under Wisconsin law, child “custody” is the right to make major decisions regarding the minor children. In Wisconsin law, “placement” refers to the schedule that the children will have with each of their parents.
